Professional background
Dr. Alban is board certified in emergency medicine and holds an MBA with formal training in finance. He began his career in indigent criminal defense with the Brooklyn Legal Aid Society, then expanded into civil litigation and into professional licensing matters before administrative tribunals.
Over more than twenty years he has supported over 150 matters as an expert, across record review, written opinion, deposition, and trial testimony. Engagements have come from plaintiff and defense counsel in civil matters and from both prosecution and defense in criminal ones.
Areas of personal expert opinion
Dr. Alban personally provides opinions in emergency medicine and medical causation. This includes standard of care in the emergency department setting, triage and diagnostic decision-making, injury mechanism and causation, distinguishing acute traumatic injury from pre-existing degenerative disease, medical records review, and independent medical review.
For every other discipline, an independently credentialed expert in that field is sourced, vetted, and placed, and Dr. Alban remains involved through report review and trial preparation. Reports and testimony are prepared with the governing admissibility standard in view: the Sargon gatekeeping analysis under California Evidence Code sections 801 and 802; the Frye general-acceptance test alongside ER 702 in Washington; the Brown and O’Key framework under OEC 702 in Oregon; and Federal Rule of Evidence 702 as amended in December 2023 in the federal districts of the Ninth Circuit.
Testimony is available in state and federal courts throughout California, Washington, and Oregon, in person and by remote deposition.
